MYKEJA PLATFORM - GENERAL TERMS & CONDITIONS

Welcome to MyKeja. These General Terms and Conditions ("Terms") govern your access to and use of the MyKeja platform, including our website, mobile application, and related rental management services (collectively, the "Service"). By registering for or using our Service, you agree to be bound by these Terms and our Privacy Policy.

1. Statutory Compliance & Scope

MyKeja is a technology platform connecting property owners ("Landlords"), authorized representatives ("Agents"), maintenance personnel ("Caretakers"), and prospective or current tenants ("Seekers" or "Tenants"). These Terms comply with the laws of Kenya, including but not limited to the Rent Restriction Act (Cap 296), the Landlord and Tenant Act (Cap 301), and the Data Protection Act (2019).

2. User Accounts & Verification

• Eligibility: You must be at least 18 years of age to register an account.
• Accuracy: You agree to provide true, accurate, and complete information during registration.
• Security: You are responsible for safeguarding your password and account credentials.
• Verification: Users listing properties or facilitating financial transactions may undergo verification processes, including submitting national identity cards or business registration papers.

3. Financial Transactions & Fees

• Platform Payments: Payments processed via M-Pesa, card, or manual billing are subject to transaction fees, where applicable.
• Refunds: Booking fees, deposits, and subscription payments are non-refundable unless explicitly stated otherwise or mandated by Kenyan courts of competent jurisdiction.
• Disputes: Users agree to first seek reconciliation through the MyKeja dispute center before initiating external legal proceedings.

4. Limitation of Liability

MyKeja acts solely as an intermediary service provider. We do not own, control, or manage the physical rental properties listed on our platform and disclaim all liability arising from physical lease disputes, property damage, or default on rent payment.
