ESTATE AGENT TERMS & CONDITIONS

These Agent Terms govern all licensed and independent Estate Agents using the MyKeja platform to market properties and manage tenant leads.

1. Estate Agents Act Compliance

• Licensing: You must hold a valid license under the Estate Agents Act (Cap 533) of Kenya, or operate under the direct authorization of a licensed firm or registered landlord.
• Representations: You are legally prohibited from listing properties without the express written consent of the respective landlord/owner.

2. Professional Conduct & Commission

• Transparency: Agents must disclose all booking fees, agency fees, and commissions upfront. Double-charging seekers without landlord knowledge is strictly prohibited.
• Viewing Bookings: You agree to honor scheduled physical and virtual viewing bookings. Virtual viewings via Google Meet must show realistic live walkthroughs of the advertised unit.

3. Lead Management & Indemnity

• Data Usage: You agree to use tenant details solely for facilitating lease agreements and viewings through MyKeja.
• Indemnification: You agree to indemnify MyKeja against any legal claims, fines, or losses resulting from unauthorized listings, misleading rental advertisements, or misrepresentation.
